Congratulations to our Dispute Resolution Practice Group who won at the Court of Appeal

Date: 17 August 2017


Former Malaysia Tourism Promotion chairman and Ex-Member of Parliament loses his appeal against AirAsia Berhad to obtain discovery of certain documents in a widely reported defamation suit brought by the leading low-cost airline.


Lead Counsel Leonard Yeoh, appearing for the airline, argued successfully that when relying on the defence of justification, the appellant cannot seek discovery of documents from the respondent (AirAsia Berhad) to justify his statements, especially when the orders sought amounted to a fishing expedition.


Leonard Yeoh represented AirAsia Berhad, assisted by Yeoh Jit Wei and Yeo Yen Hock.

UM Law Career Convention

Antitrust in Asia

Tay & Partners Wins for AirAsia

Tay & Partners represented AirAsia Berhad in a competition law appeal against a decision alleging market sharing between the budget airline and Malaysia Airlines System Berhad. Tay Beng Chai heads the team of Leonard Yeoh, Wong Weng Yew, Nicole Leong and Lynette Yee who secured a landmark victory decision before the Competition Appeal Tribunal which ruled that the Malaysia Competition Commission’s market sharing infringement decision and the financial penalty of MYR10 million must be set aside. This unanimous decision by the five-member tribunal marks the first decision delivered by the Competition Appeal Tribunal after the Competition Act 2010 came into force 4 years ago in Malaysia.

Meeting with Russian Delegation

Our Managing Partner, Mr. Tay Beng Chai moderated the open discussion on a talk themed “Going Global” at a business tea talk jointly organised by Malaysian International Chamber of Commerce and Industry (MICCI) and EXIM Bank Malaysia. Data Protection Summit

Tay & Partners together with Bird & Bird had presented a half day seminar on Data Protection Summit on 12 February 2015 at Parkroyal Hotel Kuala Lumpur with 53 participants. The seminar provided an overview of the EU data protection regime which was presented by Mr. Gabriel Voisin from Bird & Bird UK and the recent developments in Asia Pacific data protection laws which was presented by Mr. Dharma Sadasivan from ATMD Bird & Bird Singapore. Our partners Ms. Lee Lin Li and Mr. Chang Hong Yun spoke on the Malaysian legislation with particular focus on the transfer of personal data overseas. The seminar also outlined the various ways in which companies should handle issues relating to the transfer of personal data overseas. The speakers also explained the challenges faced by data users.

Expanding Your Business Across Borders

Tay & Partners had presented a talk entitled “Expanding Your Business Across Borders” together with Bird & Bird and KK Advocates. Our speaker, Ms. Lee Lin Li was joined by Dr. Mark Abel and Mr. Graeme Payne from Bird & Bird UK, Dr. Sven-Michael Werner from Bird & Bird China and Mr. Justisiari Kusumah from KK Advocates Indonesia. The talk was held on 20 January 2015 at Parkroyal Hotel Kuala Lumpur with 60 participants. The seminar outlined the various ways in which franchising can be used as part of an international growth strategy and focused on the regulatory issues that are encountered on entering both the Chinese and Indonesian markets. The seminar also highlighted the challenges that Malaysian companies face when bringing foreign franchise concepts into Malaysia.

Breakfast Briefing on Personal Data Protection

As part of a series of sector specific briefings on the newly implemented Personal Data Protection Act 2010, a talk was held exclusively for a select group of Real Estate and Housing Developers' Association Malaysia (Rehda) members on 28 November 2013 at the Levain Boulangerie & Patisserie. The firm was pleased to have Dr Zainal Abidin, the Deputy Director General from the Personal Data Protection Department as its honorary speaker and the presence of Ms Noreen Iszani, the Head of Registration Unit. Our partners, Ms. Su Siew Ling and Ms. Cheah Chiew Lan, spoke on compliance and legal issues that affect property developers and there were exciting exchanges of questions and issues from the floor. Help The Homeless 2017

We are glad and blessed to be allowed to share our raise awareness and experience with those in less fortunate situations for our CSR Project with Pit Stop Community Café on 24th November 2017.

The PitStop Community Café is located at 101, Jalan Tun H.S Lee (Bangkok Bank area) and their objective is to reach out to an assist marginalized communities through food and services with the ultimate aim of reintegration into society. The project’s founder, Joycelyn Lee & Andrea Tan, said they did not just dish out food but hoped to give more to the community.

Tay & Partners Sports Club recently brought together with the non-food items and also dinner sponsorship. The big blue enamel pots hold oats porridge, vegetables and meat stew, green bean and red bean bubur. Pieces of bread, looking like sourdough, and biscuits are handed out, too. While other soup kitchens serve pre-packed food, here, they get to choose what they want and pay if they can. It gives them a sense of dignity.

PitStop brought us closer to the lives of our street friends: the daily exchange of smiles and greetings not only allowed us to make heart-to-heart connection but this eventually led to the construction of meaningful relationships.

We are so proud of the progress we’ve made as a team this year, and we will continue working closely—for the benefit of each other, and our communities for another year to come.

Christmas Cheers

Date: 20 December 2015
Venue: Lotus Charity Care Centre Society, Semenyih, Kajang


The lawyers, pupils and staffs of Tay & Partners came together on 20 December 2015 to bring Christmas cheers to the Lotus Charity Care Centre Society in Semenyih, Kajang, Selangor. The Care Centre housed a total of 30 toddlers and children between the age of 2 to 17 years of age and 23 old folks consisting of male and female between the ages of 42 to 80.

The Care Centre was colourfully decorated with balloons and a Christmas tree which was put up by the children with the help of lawyers and pupils. It was fully decorated with colourful lights and ornaments together with Christmas messages being written by the children. The children had a lot of fun when they printed their colourful hand palms onto a white piece of paper as a sign of unity. A clown was specially invited and entertained the children with various balloon sculptures and sing along sessions. The Care Centre was also treated to a wide spread of dishes for lunch.

Each resident of the Care Centre was presented with a personalised gift consisting of a complete set of school uniform, stationeries, t-shirts, blouses, sarongs and bermudas whereas the Care Centre receives some much needed items like a fridge, vacuum cleaner, iron + iron board, hair clipper, a stand fan and consumable sundry goods which were bought with the money collected via a donation drive organised by Tay & Partners. A carom board was also presented and some staffs brought party packs and toys to be distributed at the Care Centre. The event for the day ended with a carolling session by all those who were present.

Back to School Programme & Chinese New Year Celebration 2014

Venue: SJKC Ming Tee, Tiram Baru, Tanjong Karang, Selangor


Tay & Partners has once again joined hands with Project Made and sponsored to the Back to School Programme at the SJKC Ming Tee in Tanjong Karang.

On 25 January 2014, a team of 21 staffs and their families from Tay & Partners brought together with them back to school items for 50 poor students of SJKC Ming Tee. Each student was given a set of school uniform, a bag, a pair of shoes and socks and a stationery set.

As Chinese New Year was around the corner, Tay & Partners also sponsored a festive food parcel to some poor Chinese families. The food parcel comprised of rice, meehoon, sugar, soya sauce, oyster sauce, sardines, eggs, Milo, tea, biscuits, dried mushroom, luncheon meat, Chinese sausage and mandarin oranges. The children were also given an angpow packet each.

Burmese Refugee Feeding Programme

Venue: United Learning Centre


Tay & Partners recently worked together with Project MADE and sponsored the Burmese Refugee Feeding Programme at the United Learning Centre (“ULC”). Project MADE is a small NGO and a non-profit organisation whose mission is to assist the poor and underprivileged regardless of race, religion, culture or political affiliations targeting specifically, the rural and unreachable communities.

TULC was started by Myanmar refugee, Jonathan Tanhla and his wife Grace. It is a volunteer driven centre aimed at providing education to children of Burmese refugees and to prepare them for resettlement in a third country. Located behind Imbi road and the busy area of Bukit Bintang, ULC runs solely on public contribution. Currently over 100 children are attending classes at ULC.

On 20 April 2013, a team of 19 staffs and their families from Tay & Partners brought together with them food parcels to the ULC. The food parcels comprised of rice, meehoon, sugar, soya sauce, oyster sauce, sardines, eggs, Milo, tea, biscuits, fresh vegetables and fresh meats. Tay & Partners also donated much needed cooking ingredients and food to 15 single moms, milk for lactating moms and pre-loved clothes and toys to children. The event ended with a Tay & Partners sponsored lunch comprising of chicken rice and cup cakes and the children were each treated with a Tay & Partners goodie bag consisting of toothbrush and toothpaste, nutritional snacks, stationery and toys.

Sungai Lui English Carnival & Health Drive

Venue: Kampung Sungai Lui, Selangor


Tay & Partners were at Kampung Sungai Lui to help out at the English and Medical camp at Sekolah Kebangssan Sungai Lui. The event was held in conjunction with Rotary Club of Kuala Lumpur DiRaja and was also supported by Pfizer and Nestle. Apart from our 14 strong contingent who helped conduct the English programme, Tay & Partners also made a donation to the school’s PTA.
